A federal judge has dismissed xAI’s lawsuit accusing OpenAI of involvement in the theft of trade secrets, marking another legal setback for Elon Musk’s AI company. In a ruling issued on Monday, US District Judge Rita F. Lin sided with OpenAI and dismissed the case with prejudice, meaning the lawsuit cannot be brought back to court in the future.
The dispute dates back to September 2025, when xAI alleged that OpenAI had benefited from confidential information improperly taken by a former xAI employee. The accusation followed a separate legal action filed by xAI against that former employee a month earlier. OpenAI rejected the claims, maintaining that it had no connection to any alleged misuse of proprietary information.
Earlier in the proceedings, the court dismissed the original complaint but allowed xAI an opportunity to revise and resubmit its allegations. After filing an amended version, xAI attempted to strengthen its case, but OpenAI once again sought dismissal. Judge Lin ultimately concluded that the revised complaint still failed to establish a sufficient link between OpenAI and the alleged misconduct involving the former employee.
The latest ruling adds to a growing list of legal clashes between Musk and OpenAI. Earlier this year, another high-profile court battle ended unfavorably for Musk after a jury determined that his claims regarding OpenAI’s alleged breach of agreements tied to its original mission and nonprofit structure were filed too late under applicable legal deadlines.
